What type of compensation can be recovered for your injuries?

In negotiations or litigation against any at fault party or their insurance company the possible damages that are available to an injured client for damages are outlined below:

  • Past and Future Medical Expenses: This may include charges incurred as a result of the motor vehicle accident for emergency room visits, hospital care, doctor’s visits, surgery, and therapy prescribed by appropriate medical professionals, as well as, medical bills and treatment that can reasonably expected to incur in the future.
  • Lost Wages: An injured client may be able to recover compensation for their past wages that an injured client would have earned had the accident not occurred, from the time of the accident to the conclusion of the claim.
  • Loss of earning capacity: Compensation may be available to the injured party if he/she can demonstrate that their ability to earn has been negatively as a result of the injury.
  • Pain and Suffering: The injured party may seek compensation for the physical pain suffered as a result of injuries sustained in the crash. Only when that “threshold” has been met by a preponderance of the evidence can a jury then award damages for pain and suffering.
  • Mental Anguish: This may be awarded for emotional pain suffered as a result of the injury/accident. This can compensate the victim for fright, embarrassment, nervousness, worry, grief and other forms of emotional distress.
  • Loss of Consortium: The uninjured spouse of an accident victim may be able to recover damages for loss of marital benefits, including companionship, sexual relations, affection, and comfort.
